1. Scope

 
1.1 The following General Terms of Use („GTC“) apply in the version valid at the time of use, even if access is from outside the Federal Republic of Germany. The following regulations apply to the use of Platform Event Inc („Portal“) operated by various country domains between Eventinc GmbH,  Am Sandtorkai 37, 20457 Hamburg, represented by it’s management Ms Janna Schmidt-Holtz, HRB 146542, together with all subsections, hereafter referred to as „Event Inc“, and the user of the portal, hereafter referred to as „User“. All deviations require explicit written confirmation by Event Inc. Through every use of the portal, the User agrees to the validity of these terms and conditions. Any special promotions initiated or supported by Event Inc and other means of access (eg via applications) may be subject to deviations and / or supplementary special terms and conditions.

 
1.2 The use of the portal is free for the User. Additional paid services for providers, in particular commercial customers, are subject to separate contractual agreements and are not covered by these terms of use. In addition to these terms and conditions Users may apply special terms and conditions for Providers which – if available – are linked at this point.

 
2.  Performances of Event Inc

  
2.1 Eventinc GmbH is the operator of the Internet portal Event Inc and allows Users to find suitable „Providers“ (eg event locations, event agencies, caterers or other event service providers) for events and facilitates non-binding requests between them („Enquiries“).

2.2 Event Inc markets the Providers through a profile („Supplier Profile“) on the Event Inc-powered portal which Event Inc will creates. The Provider profile consists of profile data (descriptive texts, contact data, etc.) and media (specifically photos, videos) provided by the Provider or sourced by Event Inc upon commissioning.

 
2.3 Event Inc as advised by e-mail, enquiry form and on the phone by the User, can recommend vendors, share information about vendors with the User or obtain information and offers on behalf of the User. On behalf of the User, Event Inc can make enquiries itself and obtain anonymised offers for an offer comparison of Providers. The advice, in particular the suggestion of Providers, at the discretion of Event Inc, is for general information purposes and does not justify any claims from the User against Event Inc for accuracy and completeness.

 
2.4 Request Management: Event Inc reviews and manages incoming requests. Event Inc is oriented in particular to the wishes of the Users in the enquiry as well as the profile data of the Providers and it reserves the right to supplement enquiries, to process and not to forward inappropriate or incorrect enquiries to the Provider.

 
2.5 Event Inc establishes contact between the User and the Provider and has no influence on either the actualisation or non-fulfillment of an order or further contact resulting from an enquiry. In the case of a brokered request, a contract is concluded only between the User and the respective Provider. Within this contract, separate terms and conditions may apply. The same applies if the User uses additional services from the Provider. The User is obliged to check the exact content of the contract with the provider to ensure accuracy.

 
3.  Correctness of displayed information, limitation of liability and copyright

 
3.1 Event Inc provides information about various event providers free of charge. The information displayed on the website is for the sole purpose of the User’s decision-making. The displayed order of the Provider profiles on the website, or the advice given does not imply any conclusion about the quality of the Provider. Event Inc is not responsible for the assessment of the value of the Provider by the User.

 
3.2 Despite Event Inc’s efforts to keep the website up-to-date, informative and correct, Event Inc does not warrant or accept any liability for the accuracy, timeliness and completeness of the content presented. In particular, Event Inc expressly disclaims any responsibility for any content (text, images, data sheets, etc.) provided by Event Inc for the purpose of creating the individual supplier profiles.    

 
3.3 The information on this page is for general information and does not constitute legal or tax advice. Event Inc is also not liable for breaches of duty by third parties.    

 
3.4 Any information about Providers on our portal is intended to facilitate an independent decision by the User for one or more Providers, of which Event Inc has no influence. None of the information presented is to be understood as a promise of a guarantee or assurance.

    
3.5 Event Inc is only liable for damages that are based on an intentional or grossly negligent breach of duty by Event Inc, a legal representative or commissioned agent. Liability for other things and for slight negligence is excluded except in the case of a breach of a material contractual obligation as well as damages from injury to life, limb or health.

    
3.6 Linked pages are carefully checked by Event Inc. Event Inc expressly sets itself apart from all content on third party websites and accepts no liability for such sites and/or any damages in connection with the use of such links.    

 
3.7 Upon suspension or interruption of the website, any liability for any costs, damages or losses incurred is excluded, in particular, due to necessary maintenance work, force majeure or technical disruptions of the Internet. Event Inc aims to make the portal available to Users and the general public with an annual average availability of 95%. Downtime which is used to improve, redesign and / or optimize the Event Inc portal (eg software updates, increase security, redesign or optimization of content and presentation) and technical measures (eg server maintenance) are not taken into account in the aforementioned annual average

 
3.8 There is no claim of a user against Event Inc that provides our portal permanently and / or unchanged. Changes are possible at any time.

 
3.9 All data and information, in particular pictures, illustrations, video clips and descriptions are protected by copyrights, trademarks and other intellectual property rights. The data and information may not be copied, reproduced, republished, uploaded or otherwise made public, including via e-mail and other electronic means, and / or made available to the public, unless Event Inc expressly allows. Without the prior written consent of Event Inc, there can be no alteration to or use of the data and information on other websites or on network-connected computer environments, and their use for any purpose other than personal, non-commercial purposes. Any of the aformentioned actions will be seen as a violation of copyright, trademarks and other intellectual property rights and is thus prohibited. Furthermore, it is not permitted without the consent of Event Inc to download, reproduce and distribute the website as a whole or parts thereof. Any use of the content for commercial purposes without the permission of Event Inc is prohibited. The transfer of content to third parties without the consent of Event Inc is not permitted. The inclusion of a hyperlink on the portal is prohibited if the page behind this link contains morally offensive, violent, racist or criminally destructive information.

 
4.  Obligations of the User

 
4.1 The User is prohibited, when using the services of Event Inc., to violate the rights of third parties or otherwise harass third parties, as well as any misuse or taking of illegal actions. The User is obliged to use the services of Event Inc with the utmost care. The User shall refrain from any action that is likely to directly or indirectly affect the server integrity or stability of Event Inc.

 
4.2 The input and sharing of personal data by the User takes place online via the registration form prepared by Event Inc. Only the User themselves are responsible for the accuracy and extent of the personal data entered and shared. In the instance of intentionally false or untrue personal data being submitted by the User, Event Inc reserves the right to exclude it from the use of any offered or provided services and to demand compensation for any damages incurred as a result.

 
5.  Registration of a User account

 
5.1 For the use of some services of Event Inc., registration as a User („User account“) is required. A claim to the registration of a User account does not exist. A User account is non- transferable and is free of charge.

 
5.2 The data requested by Event Inc. during registration must be given in full, to the best of the User’s knowledge and kept up to date. Users are responsible for all activities made using their User account.

 
5.3 Event Inc. reserves the right to delete User accounts at any time.

6. Conditions for the use of the email service

7.  Other regulations

 
7.1 Event Inc. reserves the right to vary these Terms and Conditions unilaterally from time to time. You should regularly check and read the Terms and Conditions for any updates and/or amendments. Event Inc. will notify via email no later than two weeks should these Terms and Conditions change. If a User does not object to the validity of the amended GTC within two weeks, the amended GTC shall be deemed accepted.

 
8.  Final provisions

 
8.1 These terms and conditions are final for the settlement of the legal relationship between Event Inc and the User.

 
8.2 Should any provision of these Terms and Conditions or any part of such provision be or become invalid, this shall not affect the validity of these Terms and Conditions as a whole. In place of the invalid provision, the relevant statutory provisions apply.
